Definitions
Facility - The space and equipment at level 1, 228 Harbord Road Brookvale
1. LIABILITY
1.1 Subject to the extent permitted by law, we and our Related Entities exclude any liability to you or any other person in tort, statute, or in any other way for any injury, damage or loss of any kind whatsoever (including, without limitation, any liability for direct, indirect, special or consequential loss or damage) sustained by you and/or any other person, or for any costs, charges or expenses incurred by you, arising from or in connection with this Agreement and/or the services/products provided by us and any act or omission by us.
1.2 You agree that you will be liable for any injury, loss, or damage suffered by any person resulting from your use of our Facility, products, services, or premises, and you agree to indemnify us and our Related Entities against any costs, losses, damages or claims brought against us by any person in relation to such injury, loss, or damage.
2. YOUR ACKNOWLEDGEMENTS AND ASSUMPTION OF RISK
2.1 You understand and acknowledge that:
(a) during such times that you frequent a Facility or participate in an activity, be it internal or external, that you are doing so at your own risk;
(b) the risk of injury from using equipment in a Facility or participating in activities is significant, and may include permanent paralysis or death and you knowingly and freely assume all such risks;
(c) we purchase or lease the fitness and exercise equipment from third parties and therefore do not manufacture any of this equipment, and we are providing recreation services and may not be held liable for defective products or equipment;
(d) you will not hold us or our Related Entities liable for any personal injury, damage to or loss of belongings which may arise from ours, or our Staff, members, clients, contractors or associates, negligence;
(e) whilst at a Facility you may at times be unsupervised and you assume all risks associated with using any fitness and exercise equipment and exercising alone without the aid and presence of any Staff;
(f) subject to this Agreement, you are not otherwise entitled to bring any guests to a Facility without our prior written consent, and if you do so, we may, at our sole discretion, suspend or cancel your Membership and the remainder owing on the Membership will be a debt due and payable to us;
(g) we have the right to cancel or suspend your Membership and exclude you from the any Facility (in each case, temporarily or permanently at our sole and absolute discretion) if you do not behave in an orderly manner, are under the influence of alcohol or drugs, are abusive to Staff and/or other members, use equipment improperly, dangerously or in a way that may lead to personal injury (whether to you or others) or you cause property damage of any kind, or do not adhere to any of the terms of this Agreement; and
(h) by becoming a Member, you understand that this Agreement is legally binding whether your use is limited to one visit (casual) or you are on a Membership Plan.
3. RELEASE AND INDEMNITY
3.1 You hereby release and indemnify us and our Related Entities, our respective officers, affiliates, agents, Staff, employees, contractors, and other participants, with respect to any and all injury, disability, death or loss or damage to person or property, whether arising from our negligence or otherwise, that may arise out of or in connection with your use any of the equipment or the facilities provided by us, your participation in any activity, or any incident that occurs while using the Facility or participating in any activity.
3.2 To the extent permitted by law, we and our Related Entities hereby exclude any liability to you for any injury, loss or damage to you or your property sustained by you or any other person for any costs, charges and expenses incurred by you arising from or in connection with this Agreement and/or the services provided by us and including any act or omission by us.
3.3 You expressly agree that this release is intended to be as broad and inclusive as permitted by law. If any part of this Agreement is void, unenforceable or illegal in a jurisdiction it is severed for that jurisdiction. You acknowledge that the remainder of this Agreement has full force and effect and the validity or enforceability of that provision in any other jurisdiction is not affected.

TERMS & CONDITIONS OF MEMBERSHIP AND USE OF GYM
Terms & Conditions Version 1.02 – Stuff you should know
Definitions
Facility - The space and equipment at level 1, 228 Harbord Road Brookvale. Also referred to as “Gym”.
Classes - Scheduled/instructor led, group fitness classes
Open Gym - member access to use the Facility and equipment outside of class hours and within permitted opening hours. This is only available to members on unlimited passes and does not apply to other membership types or trial periods.
1. THINGS TO KNOW AT THE START OF YOUR MEMBERSHIP
To assist us in maintaining a safe and comfortable environment for all members and staff, you are required to abide by the following terms and conditions. As a member, or casual user at Tone Athletica, you can use our facility in line with these terms and conditions, including the gym code of use.
SIGNING YOUR AGREEMENT
You have an agreement with us, and these Terms and Conditions apply when you have signed the Membership Application form or On-Line Waiver and we have accepted it. There is a 7 day cooling off period after your membership is accepted (except in the case of Flexi– fortnightly memberships).
If these Terms and Conditions, or your Membership Application form or On-Line Waiver differ from anything you were told at the facility or over the phone, these terms and your Membership Application form or On-Line Waiver will apply, unless written confirmation is received from a Tone Athletica employee. It is important that you have read and understood all of these Agreement terms and conditions before signing the Membership Application form or On-line Waiver. If you have any questions please ask us.
PAYING A START-UP FEE AND CONTRACT PERIOD
We DON’T charge a membership start-up fee when you join, or make you sign up for lengthy contract terms – It’s your choice. Hurray!
UNDERSTANDING OUR RIGHTS
If we do not enforce our agreement rights at any time, it does not mean we have waived those rights, no matter how long we wait. If there is a miscalculation in your membership agreement, we have 7 days after the Membership Application or On-Line Waiver is signed to correct it.
1.1 MEMBERSHIP DURATION
Memberships are debited weekly from the members nominated start date and will continue unless the member provides written email notice to info@toneathletica.com of either their wish to suspend or cancel their agreement/membership with Tone Athletica. Full details please see 1.2 Suspending your Membership and 1.3 Membership Cancellations.
1.2 SUSPENDING YOUR MEMBERSHIP
Members may apply for their membership to be suspended, subject to the notice being given in writing via email to info@toneathletica.com prior to the next applicable membership payment date. Suspensions cannot be given retrospectively and not for less than 2 weeks.
1.2.1 Each member can take up to four weekly payments (4 weeks) free suspension per membership year (calculated from the initial membership commencement date) - a $15 per week fee applies otherwise.
1.2.2 The minimum suspension period is one fortnight, with a maximum of 8 weeks being 8 weekly payments in 12 membership months.
1.2.3 Members on a Fortnightly or Monthly contract payment type will have their suspension fee/s taken via Direct Debit or credit card at the time of their regular membership payments. Members on a Paid in Full contract type must settle their suspension fee/s in advance.
1.2.4 Suspensions for extended periods for reasons of illness, injury or pregnancy will be reviewed on a case-by-case basis. Leniency may be applied in relation to the fee and/or notice period. Appropriate medical documentation must be attached to the written request for this to be considered. Please contact the Tone Team to discuss available options.
1.3 MEMBERSHIP CANCELLATIONS
In the event you need to cancel your membership, there is a two week notice period. You may still use the gym until the expiration of the final payment. You must complete within this 2 weeks:
· two weekly debits after the written email notification of cancellation is received by Tone Athletica
The main rules about membership cancellations are that you cannot cancel:
· during a period for which you have paid (i.e. get a refund – even if you cancel during your cooling off period)
· whilst your membership is suspended, inactive or not financial
1.3.1 Determining the cancellation date and the date the cancellation fees are applied
All cancellation requests must be made in writing via email, at least 5 days prior to the member’s next scheduled membership payment date. Requests via phone, fax, text or other medium may not be processed unless adequate written documentation is provided to avoid disputes.
1.3.2 The Member takes full responsibility for ensuring that Tone Athletica has received the written notification and should be aware that the 2 week notice period will apply from the next scheduled membership payment date after the notification is received and actioned by Tone Athletica.
1.3.3 We respect and welcome your right to change your mind. However, be aware that should you wish to re-join once you have cancelled your membership, the latest pricing will become effective or there will be a minimum of a 10% increase in pricing, whichever is greater.
1.4 TERMINATION OF AGREEMENT BY TONE ATHLETICA
Tone Athletica may terminate a Membership without notice and with immediate effect where:
1.4.1 The Member breaks these Terms & Conditions or the Club Rules, either repeatedly or one serious breach.
1.4.2 Any fees remain unpaid after repeated requests for payment by the club.
1.4.3 The club is of the opinion that the Member is not suitable for continued Membership.
1.4.4 The Member puts the health, safety or well-being of staff or Members at risk. All decisions made by Tone Athletica under this clause are final and binding.
1.5 WHAT ABOUT YOUR HEALTH?
1.5.1 PROMISING YOU ARE IN GOOD HEALTH
On the day you sign your agreement and each time you use the space, you promise us that:
you are in good physical condition
you know of no medical or other reason why you cannot or should not do active or passive exercise
you will advise staff before the session if this is not the case
1.5.2 SEEKING EXPERT ADVICE
Our staff and contractors are not medically trained. They are not qualified to assess if you are in good physical condition and can exercise without risking your health, safety or comfort. If you have any doubts, we strongly urge you to seek expert advice before starting an exercise program.
1.5.3 TELLING US ABOUT YOUR HEALTH RISKS
If you believe any gym activities might risk your health, you must tell us this in writing with full details. You must also tell us if your medical condition changes after you join.
We may choose to refuse your membership agreement until:
your doctor agrees in writing that you are fit to exercise
you show us proof that you have received medical advice regarding an appropriate exercise program
2. THINGS TO KNOW DURING YOUR MEMBERSHIP AND/OR Facility USE
2.1 WHEN DO YOU PAY MEMBERSHIP OR GYM USE FEES?
2.1.1 PAYING FOR ONGOING MEMBERSHIP
You pay fees for ongoing memberships in advance each week, by direct debit from a bank account or credit card. You can pay your fees as far in advance as you like, up to the legal time limits. Using this automated payment system helps to keep our costs, and therefore your membership fees, as low as possible.
Transaction fees: A transaction fee of $0.55 applies to all membership debits. Note there is an additional transaction fee of 1.99% for all payments processed using credit cards (including AMEX). These fees are automatically applied to your account upon each transaction and are not covered by Tone Athletica.
Changes to the method of payment must be made by emailing us on info@toneathletica.com. Please note that changing payment details on the Tone Athletica App does not update on our system.
2.1.2 PAYING FOR PERSONAL TRAINING AND/OR CASUAL DROP IN SESSIONS
Payment for any Personal Training or casual drop in sessions must be made in advance and prior to the session/s for which you have booked. This can be done via the online shop on the website at www.toneathletica.com using credit card or by direct deposit to Michfit Health & Fitness P/L at Westpac Bank BSB: 032-324; Account: 439534
2.2 HOW DO MEMBERSHIP DIRECT DEBITS WORK?
2.2.1 PAYING EVERY WEEK
We will use Stripe Payments to debit your membership fees from your nominated account on a weekly basis, as set out in your Direct Debit form.

Please note that:
debit dates are pre-set for each member (i.e. usually weekly from date of your 1st session)
if one falls on a non-business day (e.g. weekend or public holiday), we will debit your account on the next business day
debits might take up to 2 days to come out of your account
2.2.2 MEETING YOUR RESPONSIBILITIES
You must make sure:
your account can accept direct debits (your financial institution can confirm this)
there is enough money in your account on the payment day and the next 5 days
you tell us if you are transferring or closing your account, at least 48 hours before your next direct debit
you tell us about any changes to your credit card, such as its expiry date or number, at least 48 hours before your next direct debit
Please tell us in writing via email and your financial institution if you want to change or stop your direct debits.
2.2.3 PRICING
Pricing is shown on your membership form and published on the Tone Athletica App and website. We reserve the right to change our prices or your fees at any time. However, we will make a reasonable effort to tell you about this at least 14 days beforehand by writing to the address you last gave us (which may be an email address). We will consider that you have received our letter or email on the second business day after it is sent. We won’t apply a price or fee change, to any period for which you have already made payment.
Where we have made a reasonable effort to let you know about a fee change or you have requested a change in membership type, you authorise us to change the debit amounts from your nominated account accordingly.
In the event we offer a special promotion with a discounted membership fee for a set period of time, the membership pricing will revert back to standard pricing at the end of the promotional period and will continue until the full membership period expires or the membership is cancelled.
2.2.4 LOSING YOUR GYM ACCESS
If you do not fully pay your fees on the due date, we will suspend your gym access until your payments are up to date and you have given us your account details. We will also charge you a late payment fee of $15 for a failed payment. This will be debited from your account, and you authorise us to do this.
2.2.5 PAYING YOUR OUTSTANDING DEBTS
We will continue to debit your nominated account without notice, until we have received the total amount you owe us. We will make a reasonable effort to let you know beforehand by:
phoning you or speaking to you at the space
writing to the address you last gave us (which may be an email address)
For membership/s in your name, you must make sure that the payment method you choose continues as long as your agreement is in force. This includes third-party accounts. If the details you give us fail, you are liable for all resulting fees. You should update your details and are obligated to repay any outstanding debt.
2.3 HOW LONG ARE YOUR LIMITED SESSIONS/WEEK VALID?
When you have limited sessions per week (i.e. 2 or 3 days per week), they are to be used within the fortnight for which you have paid. Generally, unused sessions at the end of a paid fortnight, are forfeited.
2.4 WHAT IF YOU WANT TO SUSPEND YOUR MEMBERSHIP?
2.4.1 ANNUAL HOLIDAYS
You may suspend your payments free of charge from a minimum of 1, to a maximum 8, weeks per membership year.
As mentioned earlier, in 1.4 Cancellations, you can’t get a refund on an already debited payment, so you must let us know before the event that you wish to suspend your payment/s. A little bit of planning ahead of time can save you some anguish and maybe cash too!
2.4.2 DUE TO ILLNESS OR INJURY
In most injury cases, you should be able to participate at a reduced level in your sessions. If not, or in the case of illness, the minimum free suspension period is 1 week up to a maximum of 8 weeks. See full details and terms and conditions under 1.3 Suspending your Membership. Please provide a Doctor's certificate in these cases. Again, as per 1.4 Cancellations, there are no refunds so the suspension can only take effect from the next scheduled fortnightly payment date and must be notified at least 2 business days prior.
2.4.3 SUSPENSIONS – GENERAL INFORMATION
The gym is closed on Public Holidays and some other extended holiday periods. These reduced training hours are already accounted for in the cost of the Tone Athletica membership. Where there are other training interruptions, in extenuating circumstances, please discuss the possibility of delaying or putting payments on hold for a period and cost to be determined.
3. GYM CODE - RULES OF USE
You must follow our gym code. Please read and follow all signs and handouts that tell you what to do. If you don’t understand something, please ask the staff for help.
3.1 SESSION TYPES
3.1.1 CLASSES
During scheduled class-times the gym will be used for class attendance only. No open gym use is permitted during scheduled classes
3.1.2 OPEN GYM
Open Gym will be available outside of scheduled group classes between the hours of 7:00am to 7:00pm daily. Active members who’ve signed up for dedicated access may attend the gym and train un-supervised as long as they adhere to the following guidelines. You will be required to sign a waiver accepting the risks involved with using the gym unsupervised (see Liability Waiver - Section 2.1(e) - Unsupervised use of facilities).
3.1.2.1 OPEN GYM GUIDELINES
ARRIVAL & ACCESS
(a) Access to the facility during Open Gym hours will be from the Level 1 Door Only. No street level access is permitted.
(b) You park in the facilities car park at your own risk. To the extent permitted by law, we are not liable for any loss or damage to your vehicle or its contents.
(c) Members who wish to access open gym will provision a unique four digit pin. This pin access is for that member only. You are not to share your pin code with anyone.
(d) Only current and active unlimited members can access the facility during Open Gym times.
(e) No individual under the age of 16 years is permitted to use the facility and its equipment unless supervised by an adult 18 years or older.
(f) Access by Children
(1) For safety reasons Non-member Children are not permitted in the facility unless permission is granted by Staff. Any Member who allows a non-member Child or Children access to the facility without permission will be liable for the Unauthorised Entry Fee and may have their membership immediately cancelled.
(2) Children of members may accompany the member but must stay in the creche area at all times. Children are not permitted to use any equipment other than creche items AND parents/guardians are responsible for the supervision and safety of their children at all times.
(g) No member shall use their access pass for another member.
(h) You must not bring or admit any Non member to the space unless express permission is obtained from the owner via email info@toneathletica.com. If you breach this clause then:
(1) you accept responsibility and liability for any injury, loss or damage attributed to the non-member;
(2) the act of bringing an unauthorised non-member into the facility will incur a fee of $50. Subsequent breaches of this obligation will incur additional fees and membership cancellation.
WHILE USING THE FACILITY
(i) All doors must be closed while you’re training. For your own safety you should not open the door for others. Other members will use their own pin code to gain access.
(j) For your safety, CCTV is in operation in all public areas with all footage retained for a minimum of 3 months.
(k) We have a strict 7:00pm lockout. Security system activated after hours.
(l) Emergency telephone numbers and procedures are posted in the gym and should be followed if an emergency arises.
(m) Personal training sessions may be held during Open Gym hours. Members are asked to be respectful of the trainers and trainers attendees and to give them priority to any machines or space required in the gym.
(n) Members are expected to treat each other with respect at all times.
(o) All equipment (including weights) must go back to their rightful place and be wiped down after use.
(p) Rope climbing, barbell bench press, overhead press and barbell front and back squats are prohibited during Open Gym hours unless you have a spotter at all times.
(q) All members must wear suitable clothes and enclosed sports shoes in the space. We do not allow clothes with offensive images or inappropriate advertising.
(r) You are required to use a clean towel during open training times to maintain our hygiene and safety standards.
(s) You must not use cameras in the facility without our permission. Taking photos or videos of other members without their consent is a breach of our terms and conditions.
BEFORE YOU LEAVE
(t) Prior to leaving the space, It is the responsibility of the last member leaving to ensure all windows are closed, all lights are turned off, air conditioners turned off and doors are locked prior to leaving the space. Note: The last two light bays nearest the roller door are on a motion switch and will automatically turn off by themselves.
3.2 RESPECTING OUR EQUIPMENT
You are responsible for using our facilities and equipment correctly, including adjusting levels or settings. If you are not sure how to operate any equipment, please ask our staff before you use it.
Note that you will be responsible for any damage that you cause through a wilful act or negligence
As a courtesy to other members, please use a clean towel when you use equipment, including exercise mats. Clean and put equipment away after use.
Note also that you must not use a camera in the gym without written permission.
3.3 KEEPING YOUR BELONGINGS SAFE
We provide space for storing your items while exercising but these are not security lockers. We cannot accept responsibility for any loss or damage to your belongings while you are in the Space. If you leave belongings in a storage space overnight, we may remove them. We give lost property to charity each month, including unclaimed items from storage spaces.
3.4 WEARING SUITABLE GYM CLOTHES
All members and guests must wear suitable clothes and enclosed sports shoes in any exercise areas. Please bring a towel for your personal use.
Entry will be refused or you may be requested to leave the facility if:
you are using abusive or threatening language or behaving in a threatening way; or
you are under the influence of drugs or alcohol; or
you behave in another way that is considered by Tone Athletica to be risky or seriously inappropriate.
3.6 NO SMOKING
Our facility is a non-smoking facility. The smoking of cigarettes or electronic cigarettes (e-cigarettes or vapes) is strictly prohibited.
3.6 PARKING
You are welcome to park in the Level 1, 228 Harbord Road car park or at street level at your own risk. We are not liable for any loss or damage to your vehicle or its contents. Please ensure you respect any allocated parking signage.
If you have small children or guests, you are responsible for ensuring their safety in the Level 1, 228 Harbord Road car park and in the areas/streets surrounding.
3.7 ACCESS
Members who choose to utilise the open gym will provision a key/pin to gain access (see section 3.1.2.1(c)). Personal key/pin access is not required to attend scheduled classes.
Members access will be deactivated in the event their membership is Cancelled or Suspended (see Canceling your Gym access & Losing your gym access)
3.8 CRECHE GUIDELINES
Exercise is a very important part of our lives, so we want to do as much as we can to make it easier for you to lead a healthier and happier life.
In consideration of Tone Athletica allowing my children to participate in the crèche, I acknowledge, understand and am aware that I have voluntarily allowed them to participate and agree to the waiver I have previously signed in respect of myself, to extend to them.
Our child minding facility is offered to members to help Mum’s achieve their health and fitness goals while our staff look over their children.
Even though this is a temporary facility, the carers are experienced (mostly they are Mum’s themselves). However, they are not qualified child carers. They are here to assist as much as possible however, in the event that your child is unhappy, can’t be settled or is in need of a sanitary change, the Mum/guardian will be notified immediately to take over.
Please Note: For your convenience, school aged children will be allowed in the crèche during the school holidays (applicable fees apply).
To avail yourself of this facility you need to agree to follow our Crèche guidelines as follows:
The minimum accepted age for babies is 6 weeks old.
We ask that sick children or children with colds, flu or other contagious ailments not be left in the crèche.
The maximum allowable time for any child to be left in the crèche is 1 hour.
Only patrons utilising the centre may leave their child or children in the crèche.
Parents/guardians may be asked to sign their child in and out of the crèche.
Parents must stay on the premises when their child or children are in the crèche.
Eating will only be permitted when other children in the crèche are not inconvenienced. Do not provide food containing nuts or eggs.
A drink will be allowed.
Toys from home will be permitted when other children in the crèche are not inconvenienced.
Bring spare clothes (nappy) if the child is not toilet trained.
Allergies should be advised to crèche staff.
Please be aware that as we are a temporary facility, Vaccination statuses of children utilising the crèche are not required. However, for your child’s safety, and that of the other children utilising the crèche, we would strongly recommend having your child’s vaccinations up to date.
Non ‘Mum’s and Bub’s’ members who wish to utilise the crèche can either pay the applicable casual fee of $10/session or upgrade their membership for the required interval (fortnightly increments). Charging for casual use will be done retrospectively at the end of every week.
Crèche opening times Monday through Friday: 9.15am to 10.15am and 12.15pm to 1.15pm Monday, Wednesday, Friday. Closed weekends and Public Holidays
4.0 CHANGES TO SERVICES & OFFERINGS
We reserve the rights to vary or change classes and services, including for reasons of seasonal conditions, participation rates, Staff availability and maintenance requirements of the building. There are no refunds or credits issued for such days.
5.0 CHANGES TO TERMS & CONDITIONS
We may sometimes change our terms and conditions. The most up-to-date terms and conditions always apply. You can find copies on our website www.toneathletica.com.
If we reasonably consider that any change to the terms and conditions is likely to benefit you or be of no, or immaterial, detriment to you, we can make the change immediately and do not need to notify you.
For all other changes, we give you at least 30 days notice of any changes, for instance by writing to the address (email) you last gave us.
I HAVE READ AND ACCEPT THE facilities RULES OF USE
A warning, suspension or cancellation of access will follow if any of these rules are breached, by the discretion of the owner.

Tone Athletica uses cookies or web beacons to make use of the website and services as convenient as possible. Most web browsers are set to accept tracking technologies such as cookies or web beacons. Cookies do not themselves personally identify users, although they do identify a user’s browser. These tracking technologies allow Tone Athletica to monitor the Tone Athleica's web site, and to record how many people are using the different parts of the site.
You can turn off the cookies or web beacons on your computer, however, this may limit the services provided by Tone Athletica’s web site.
1. USING AND DISCLOSING YOUR PERSONAL INFORMATION
Personal Information will be used for the following primary purposes:
a. To fulfil obligations under a member’s membership agreement and/or any other contract between him/her and Tone Athletica;
b. To render services under a member’s membership agreement;
c. To provide information about products, service and/or special offers to members;
d. To obtain opinions or comments about products and/or services from members;
e. To record statistical data for marketing analysis from members.
Tone Athletica may employ other companies or service providers to assist us in providing our services. These third parties may have access to personal information that is needed to perform their specific function. They cannot use that information for other purposes.
Tone Athletica recognises the trust with which individuals provide personal information, and such information will not be used or disclosed for any other purposes without consent, unless lawfully required to do so.
2. CONTACT BY TONE ATHLETICA
Tone Athletica does not send advertising information without obtaining prior consent. If an individual receives communications from Tone Athletica which they do not wish to receive, they may remove their name from the database by contacting Tone Athletica at info@toneathletica.com.
3. INDIVIDUAL'S RIGHT OF ACCESS
Individuals have the right to review, amend or delete personal and/or sensitive Information that may be recorded on the Tone Athletica database. Information may be reviewed, amended or deleted by notifying your request in writing to info@toneathletica.com.
You can make a request to delete personal and/or sensitive information, and all reasonable steps to delete the information will be made, except where it is required for legal reasons.
4. STORAGE AND SECURITY OF PERSONAL AND/OR SENSITIVE INFORMATION
Tone Athletica takes all reasonable steps to keep personal information recorded secure, and to keep this information accurate and up to date. The personal information is stored on secure servers if in digital format, or in locked areas if in hardcopy format.
